Businesses considered public utilities have been clearly defined and will remain subject to the restrictions on foreign capital stated in the Constitution.
It is based on the new law signed by President Rodrigo Duterte amending the Public Service Act (PSA).
DOJ Secretary Menardo Guevarra said These are electricity transmission and distribution, petroleum pipeline transmission, water and sewerage pipeline distribution, seaports, and PUVs (public utility vehicles).
He said the foreign ownership of them will continue to be limited by the Constitution to up to 40% maximum foreign capital, while other public service industries will be free which will allow up to 100% of their foreign capital.
Under the amended PSA, the telecommunications, railways, expressways, airports, and shipping industries will be considered as public services, allowing up to 100% foreign ownership.
