MAHAHARAP sa kasong Anti-Graft and mga opisyal ng Bureau of Customs kaugnay sa kanilang pagsakote sa cargo vessel Bankapaew mula Thailand, nakaraang August 18, 2022 lulan ang toneladang sakong asukal.
Sa pagdinig ng Senate Blue Ribbon Committee, tahasang sinabi ni BOC Acting Commissioner Yogi Filemon C. Ruiz, na IN ORDER ang papeles ng naturang cargo vessel, kung saan na hold ito kasama ang mga trepulante mula Thailand.
Nagpahayag din ang Sugar Regulatory Administration sa pamamagitan ng Sertipikasyon na may lagda ni Deputy Administrator Atty. Tejida na CLEARED at hindi recyled ang papel ng Oro-Agri Trade at ARC Refreshment na siyang importer ng asukal.
Sa pagtatanong ni Sen. Tulfo, kung sino ang magbabayad ng demurahe ng nasabing consignee na naantala sa kapalpakan ng Bureau of Customs na halos sampung milyon na ang bayarin, lulmalabas na ang BOC ang magbabayad.
Ito’y ayon na rin sa Customs Modernization and Tariff Act Sec. 1111 paragraph (e) na nagsasaad “The cost of the physical inspection shall be borne by the Breau. Provided, that such cost shall be reimbursed by the owner prior to the release of the goods if the physical inspection results in the assessment of additional duties or taxes or the issuance of a warrant of seizure.”
Sa parte naman ng asukal  ng Oro Agri-Trade at ARC Refreshment na walang nilabag, ang Bureau of Customs ang magbabayad ng demurahe sa kanilang kapalpakan, sapagkat ang mga papeles ay lehetimo ayon na rin sa sertipikasyon ng SRA.
Ayon naman sa Republic Act No. 3019 otherwise known as the Anti Graft and Corrupt Practices Act o sa Philippine Constitution, Article XI on Accountability of Public Officers Sec. 3 Corrupt practices of public officers, paragraph (e) Causing any undue injury to any party, including the Government, or giving any private party, any unwarranted benefits, advantage or preference in the discharge of his official administrative or judicial fuctions through manifest partiality, evident bad faith or gross inexcusable negligence. This provision shall apply to officers and employees of offices or government corporations charged with grant of licences or permits or other concessions.
Sa kapalpakan ng Bureau of Customs ay magbabayad ito ng demurahe, na halos milyones at malinaw na pasok ito sa Anti-Graft na nasaad sa paragraph (e) CAUSING ANY UNDUE INJURY TO ANY PARTY, INCLUDING THE GOVERNMENT.”
Kaya naman, kailangan na maghanda ng maisasagot ang ilang mga opisyal ng Bureau of Customs, o kaya mag resign out of delicadeza dahil sa pagiging ignorante nito sa batas. (May susunod pa)
